HIPAA

Esker may qualify as a “Business Associate” as defined by the Health Insurance Portability and Accounting Act of 1996 (“HIPAA”) as amended by the Health Information Technology for Economic and Clinical Health Act (The “HITECH ACT”), as Title XIII of Division A and Title IV of Division B of the American Recovery and Reinvestment Act of 2009 (PUB.
